En el ordenamiento español carecemos de una norma que regule el régimen jurídico privado del contrato de transporte ferroviario de viajeros. En el ámbito jurídico público el servicio de transporte ferroviario es regulado por la Ley 38/2015, de 29 de septiembre, del Sector Ferroviario, por el Reglamento del Sector Ferroviario de 2004 y por la Ley 16/1987, de Ordenación de los Transportes Terrestres, que en materia de responsabilidad del porteador se remite al Reglamento (CE) núm. 1371/2007, del Parlamento Europeo y del Consejo, de 23 de octubre, sobre los derechos y las obligaciones de los viajeros de ferrocarril; este, a su vez, sin perjuicio de lo dispuesto en él, se remite a lo dispuesto en las RU CIV (Apéndice A COTIF). Y finalmente, el propio COTIF y sus RU CIV se remiten a los derechos nacionales que pudieran resultar aplicables, destacando particularmente la remisión en materias que afectan a la responsabilidad en caso de muerte y lesiones de los viajeros. Dada la ausencia de criterios y límites de responsabilidad en el ordenamiento español respecto a los daños personales, se proponen soluciones de política jurídica. Enmarcado en este escenario de dispersión normativa, el presente artículo tiene como objetivo el estudio del contrato de transporte ferroviario de viajeros a la luz de los nuevos textos legales que durante en el año 2015 han sido publicados y que inciden en su régimen jurídico o lo interpretan.
Spanish legislation lacks a regulation governing private law on the contract of carriage of passengers by rail. Under public law, the rail transport service is regulated by Law 38/2015, of 29 September, on the Railway Sector, by the 2004 Regulation of the Railway Sector and by Law 16/1987, on the Regulation of Terrestrial Transport, which in the area of carrier liability refers to Regulatio (EC) 1371/2007 of the European Parliament and of the Council of 23 October 2007, on the rights and obligations of rail passengers; this, in turn, without prejuice to the provisions laid down, refers to the provisions of the CIV UR (Appendix A to COTIF). Lastly, the COTIF itself and its CIV UR refer to national laws that might be applicable, particularly emphasizing remission in matters that affect liability far death and injury of passengers. Given the lack of criteria or limits of liability in the Spanish legal system far personal damages, legal policy solutions are proposed. Framed within this context of a plethora of regulations, the aim of this article is to study the contract of carriage of passengers by rail in the light of the new legal texts published in 2015 that affect or interpret its legal regime.
