The qualification as «work» of artificial-intelligence creations is an open question, for which the fundaments of the intellec-tual property are being applied. With the analysis of the AG München ruling of February 13, 2026 and the «A Single Piece of American Cheese» case of the U.S. Copyright Office as a starting point, this work aims to show the main ways used today to discern the nature of synthetic content -that of human authorship and that of subjective originality- as well as offer an overview of comparative law on the application of current legislation on intellectual property to the challenges posed by artificial intelligence.
