En el presente trabajo analizo la génesis y evolución del principio de sostenibilidad edificatoria, que es casi tanto como decir que el principio de sostenibilidad en relación con la construcción residencial, o si se prefiere, en relación con el ámbito propio de las viviendas, al constituir estas últimas, sobre todo dentro de las ciudades, la inmensa mayoría de todo cuanto se construye y edifica en ellas, en definitiva, del Patrimonio Urbano existente. Dicho estudio me lleva a analizar desde el surgimiento del principio de sostenibilidad, pasando por diversas normas que han contribuido a lo largo del tiempo a su implementación en el sector de la vivienda, fundamentalmente, a través de la rehabilitación, regeneración y renovación urbana, es decir, a través de actuaciones de reforma interior de las poblaciones, aun no siendo lo mismo, exactamente que la sostenibilidad, hasta su regulación por la relativamente reciente Ley 12/2023, de 24 de mayo, por el Derecho a la Vivienda. El resultado final de este estudio, fruto de la perspectiva que brinda, permite exponer algunas consideraciones destacadas sobre la aplicación del principio de sostenibilidad en el ámbito de la vivienda, como, por ejemplo, en primer término, que su implementación se encuentra rezagada con respecto a otras materias concomitantes, en que se encuentra mucho más asentado y goza de mayor predicamento, como en el Derecho Urbanístico o en la Ordenación del Territorio. En segundo lugar, que el intento de introducir dicho principio en la legislación de vivienda no se aborda directamente, sino indirectamente, a través de la rehabilitación, regeneración y renovación urbana, y finalmente, en tercer lugar, que el legislador de la Ley 12/2023, de 24 de mayo, por el Derecho a la Vivienda, sigue sin prestarle la atención debida y esperada, por lo que califico la regulación que hace de él como decepcionante, desalentadora y profundamente desafortunada.
In this work I analyze the genesis and evolution of the principle of building sustainability, which is almost as much as saying that the principle of sustainability in relation to residential construction, or if you prefer, in relation to the field of housing itself, since the latter constitute, especially within cities, the vast majority of everything that is built and constructed in them, in short, of the existing Urban Heritage. This study leads me to analyze from the emergence of the principle of sustainability, through various regulations that have contributed over time to its implementation in the housing sector, fundamentally, through rehabilitation, regeneration and urban renewal, that is, through actions of internal reform of the populations, although not being the same, exactly as sustainability, until its regulation by the relatively recent Law 12/2023, of May 24, on the Right to Housing. The final result of this study, the result of the perspective it provides, allows us to present some outstanding considerations on the application of the principle of sustainability in the field of housing, such as, firstly, that its implementation is lagging behind other concomitant matters, in which it is much more established and enjoys greater prestige, such as in Urban Planning Law or in Territorial Planning. Secondly, that the attempt to introduce said principle in housing legislation is not addressed directly, but indirectly, through rehabilitation, regeneration and urban renewal, and finally, thirdly, that the legislator of Law 12/2023, of May 24, on the Right to Housing, continues to not pay due and expected attention to it, which is why I describe the regulation it makes of it as disappointing, discouraging and deeply unfortunate.
