This paper analyses the case law concerning tax verification and investigative actions carried out during the so-called “fifth year” in scenarios involving criminal tax offences. Within this framework, it advocates for the precise determination of the specific tax li-ability being examined as a constitutive requirement for the validity of the administra-tive verification and investigation considering the four-year statutory limitation period applicable to tax obligations. It further maintains that neither judicial authorisation nor judicial notice is required to legitimise administrative tax verification or investigative measures undertaken during the “fifth year”, provided that such measures do not im-pinge upon fundamental rights. The study concludes by recommending that the limita-tion periods for tax liabilities and criminal prosecution be unified.
