The article examines the impact of artificial intelligence on the protection of fundamental rights, with particular emphasis on equality, privacy, and due process. It analyzes risks such as algorithmic opacity, the reproduction of biases embedded in training data, and the automation of decision-making processes without sufficient human oversight. These factors may lead to discrimination, undermine the protection of personal data, and hinder the effective exercise of the right to defense. Furthermore, the article compares the main regulatory frameworks, particularly the European Union's Al Act, the Council of Europe Framework Convention on Artificial Intelligence, and the integration of the GDPR with Fundamental Rights Impact Assessments. It argues that current regulatory mechanisms represent significant progress; however, they remain insufficient to address the challenges posed by increasingly complex Al systems. Consequently, there is a need to strengthen transparency, human oversight, and accountability mechanisms.
