The recent ruling of the CJEU of 1 August, 2005 (case 461/2024) addresses the preliminary questions submitted by the High Court of Justice of Galicia on the internal sequence of sectoral reports and the procedures for public information and consultations. It aligns with the criteria established by several previous rulings of the Supreme Court, adopting the same generic discourse and also failing to specify the specific interaction that should occur between these reports and procedures in each particular case. The aim of this paper is to answer this question. To this end, we will intertwine the judicial arguments with the applicable regulations in order to identify the informational and procedural parameters that can help clarify which sectoral reports should precede, coincide with, or follow such procedures. The ultimate objective is to highlight that preference should be given to information on procedures, as the possibility and simultaneity of the theses depend on it, as well as to identify certain anomalies in information and processing that could compromise the validity of the environmental assessment procedure itself.
Europar Batasuneko Justizia Auzitegiaren 2005eko abuztuaren 1eko epaiak (461/2024 auzigaia) Galiziako Justizia Auzitegi Nagusiaren epaitu aurreko arazoak jorratzen ditu, sektore-txostenen barne-sekuentziari eta informazio publikoaren eta kontsulten prozedurei buruz. Auzitegi Gorenaren aurreko hainbat epaik ezarritako irizpideekin bat dator, diskurtso generiko bera hartu, eta txosten eta prozeduren artean kasu bakoitzean gertatu behar den elkarrekintza espezifikoa zehaztu gabe uzten du. Lan honetan gure helburua galdera horri erantzutea da. Horretarako, argudio judizialak eta aplikatu beharreko araudiak uztartuko ditugu, izapide horien aurretik, aldi berean eta ondoren zer sektore-txosten etorri behar diren argitzen lagun dezaketen informazio- eta prozedura-parametroak identifikatzeko. Helburua da, batetik, erakustea lehentasuna informazioari eman behar zaiola, ez izapideei; izapideen aukera eta aldiberekotasuna informazioaren baitan dagoelako. Eta, bestetik, ingurumen-ebaluazioaen prozeduraren beraren baliozkotasuna arriskuan jar dezaketen informazioaren eta izapideen inguruko anomaliak identifikatzea.
