La sentencia 168/2025 del juzgado de lo social de Barcelona número 1, de 30 de junio, es la primera resolución judicial en el ámbito laboral que declara que el permiso parental ha de se retribuido por medio de salario. Los argumentos se fundamentan en que la Directiva había de haber sido traspuesta antes de agosto de 2024 y que este incumplimiento por parte del gobierno español no puede perjudicar al trabajador que solicita este permiso.
The judgment 168/2025 of the Labour Court of Barcelona number 1, of 30 June, is the first judicial decision in the field of employment that declares that parental leave must be paid through salary. The arguments are based on the fact that the Directive should have been transposed before August 2024 and that this failure by the Spanish government cannot be detrimental to the worker requesting this leave.
