Resumen Este trabajo analiza la operación de construcción jurídica denominada especificación y desarrolla la noción de concepto jurídico indeterminado desde la perspectiva de la teoría del derecho realista. A partir de estas nociones profundiza y aplica un modelo de especificación descriptivo de las operaciones que realizan los jueces en diferentes sectores normativos. Así, se defiende la tesis que afirma que más allá de las categorías dogmáticas, el método de especificación desarrollado es útil en varios sectores normativos diversos dentro del derecho público. Con el fin de mostrar la utilidad del análisis, se incluye una revisión de tres sentencias judiciales donde se muestra cómo el tribunal construye derecho dotando de contenido a conceptos jurídicos indeterminados en juego.
Abstract This paper analyzes the operation of legal construction called specification, and develops the notion of indeterminate legal concept from the perspective of the theory of realist law. Based on these notions, it deepens and applies a descriptive model of the operations carried out by judges in different normative sectors. Thus, the thesis that beyond the dogmatic categories, the specification method is useful in several different normative sectors within public law is defended. In order to show the usefulness of the analysis, a review of three judicial decisions is included, revealing how the court constructs law by giving content to indeterminate legal concepts at stake.
