La Ley 2/2023, de 20 de febrero, procede a transponer a nuestro ordenamiento interno la Directiva (UE) 2019/1937, de 23 de octubre de 2019, relativa a la protección de las personas que informen sobre infracciones del Derecho de la Unión. La norma que es objeto de análisis e interpretación en el presente artículo afecta el ámbito de las relaciones laborales desde una doble vertiente. De un lado, establece la obligación empresarial de crear y gestionar canales internos de información sobre delitos e infracciones administrativas graves y muy graves. De otro, las personas reconocidas como informantes gozarán de un estatuto especial que debe protegerles frente a cualquier tipo de represalias, también en el ámbito laboral o profesional, relacionadas con su actividad como informante. Como instrumento de control del adecuado funcionamiento del sistema de protección, la nueva normativa crea la Autoridad Independiente de Protección del Informante (AAI), que será responsable tanto de la gestión del canal externo de información como de la aplicación del correspondiente régimen sancionatorio. El presente trabajo abordará únicamente los aspectos típicamente laborales que la norma regula, esto es, los derechos y obligaciones que, en cada caso, afectan al sistema de relaciones laborales y a las personas, entidades y organizaciones involucradas
Law 2/2023, of 20 February, transposes Directive (EU) 2019/1937, of 23 October 2019, on the protection of persons who report breaches of Union law. The rule that is the subject of analysis and interpretation in this article affects the field of labor relations from a double aspect. On the one hand, it establishes the business obligation to create and manage internal channels of information on serious and very serious crimes and administrative infractions. On the other hand, persons recognised as informants will enjoy a special status that should protect them against any type of retaliation, including in the workplace or professional, related to their activity as a whistleblower. As an instrument for controlling the proper functioning of the protection system, the new regulations create the Independent Whistleblower Protection Authority (AAI), which will be responsible for both the management of the external information channel and the application of the corresponding sanctioning regime. This paper will only address the typical labor aspects that the standard regulates, that is, the rights and obligations that, in each case, affect the labor relations system and the people, entities and organizations involved.
