El uso de simbología religiosa en el ámbito laboral ha traído consigo un gran número de problemas que se ha planteado no sólo a nivel nacional, sino también europeo e internacional. Varios son los supuestos sobre los que se han debido pronunciar los tribunales a la hora de determinar si el despido de un trabajador por el uso de prendas o símbolos de una confesión puede implicar una discriminación por motivos religiosos o una violación de la libertad religiosa. En este estudio se analiza si existe derecho a portar simbología dinámica, la regulación normativa (o no) del mismo y los casos concretos que han dado lugar a los pronunciamientos judiciales en relación con el uso del velo islámico como causa de extinción de la relación laboral en empresas privadas.
The use of religious symbols in the labor environment has resulted in problems not only at the national level, but also at the European and international levels. In many cases, the courts have taken positions on whether or not the firing of an employee for wearing clothing or symbols representative of a given religious confession constitutes religious discrimination. This study explores whether or not a right to wear religious symbols actually exists, analyzes the legislation and regulations (or lack thereof) surrounding that question, and delves into the specific cases that have resulted in legal decisions being made pertaining to the termination of private-sector employment due to a person’s decision to wear the Islamic veil.
