The objective of the research is to investigate the model of the collective labor process in force in Brazil, in order to analyze if in the current system the workers have guaranteed the right to participate in the dialogical formation of procedural merit. It was verified that the Brazilian collective process has its foundations in the Representative System, which confers active procedural legitimacy to the Public Prosecutor’s Office and Trade Unions, without allowing the right of workers to participate in the procedural debate of the controversial points of the lawsuit. Through the bibliographical and documentary research and the analytical study of the Theory of Collective Actions as Thematic Actions, it has been demonstrated that the Participative System, constitutionally foreseen, assures the right of diffuse and collective (workers) interested parties to participate in the construction of the final provision of merit, ensuring the democraticity of the decision content, relativizing the protagonism and judicial discretion.
O objetivo da pesquisa é investigar o modelo de processo coletivo do trabalho vigente no Brasil, de modo a analisar se na atual sistemática os trabalhadores tem garantido o direito de participação na formação dialógica do mérito processual. Verificou-se que o processo coletivo brasileiro tem seus fundamentos no Sistema Representativo, que confere legitimidade processual ativa ao Ministério Público do Trabalho e Sindicatos, sem permitir o direito de os trabalhadores participarem do debate processual dos pontos controversos da demanda. Por meio da pesquisa bibliográfica e documental, e do estudo analítico da Teoria das Ações Coletivas como Ações Temáticas, demonstrou-se que o Sistema Participativo, previsto constitucionalmente, assegura o direito de os interessados difusos e coletivos (trabalhadores) participarem da construção do provimento final de mérito, assegurando-se a democraticidade do conteúdo decisório, relativizando o protagonismo e a discricionariedade judicial.
