Con la perspectiva de algo más de un año desde la aprobación de la reforma laboral de 2021 mediante el Real Decreto-ley 32/2021, este artículo proporciona elementos de juicio para hacer un balance, a partir de la puesta en conexión de sus objetivos principales, en particular la promoción de la contratación indefinida y la reducción de la temporalidad, con los datos de evolución del mercado de trabajo. De este modo, se pretende ofrecer aportaciones de utilidad para valorar la eficacia de la reforma, el grado de cumplimiento de sus propósitos y su recepción por los operadores del mundo laboral. A tal efecto, se estudian las transformaciones recientes del mercado de trabajo en cuanto al aumento de la contratación indefinida y la reducción de la contratación temporal, tanto en términos de número y porcentaje entre las nuevas contrataciones como de volumen total de empleo indefinido y temporal, analizando igualmente los datos sobre tasa de temporalidad. Se examina también si cabe deducir algún impacto en el volumen total de empleo / desempleo. Más allá de las tendencias positivas identificadas en todos esos campos, se abordan asimismo ciertos puntos de controversia o críticas suscitados, por ejemplo, en torno al incremento de los contratos fijos-discontinuos o sobre una posible tendencia al alza de las extinciones de contrato en periodo de prueba. Finalmente, se apuntan cuestiones y retos pendientes para futuras reformas y se esbozan algunas conclusiones.
With a time perspective of more than a year since the approval of the 2021 Labour Market Reform by Royal Decree-Law 32/2021, this article provides elements for the evaluation of its effects, connecting its main objectives, in particular the promotion of indefinite-term employment and the reduction of fixed-term employment, with the available information and figures on the employment market evolution. In this way, it intends to offer useful contributions for the assessment on the efficacy of the reform, the degree of achievement of its purposes and the response by the employers and other stakeholders. With this aim, it examines the recent transformations in the employment market regarding the increase of fixed-term contracts and the reduction of fixed-term contracts, both in terms of number and percentage among new recruitments and of total volume of permanent and fixed-term employment, including an analysis of the data on the fixed-term employment rate too. Besides, it explores whether there has been or not any kind of impact on the total volume of employment / unemployment. Moreover, beyond the positive trends identified in all those fields, the study addresses some points of controversy or criticism against the reform that have arisen in the debate, namely those related to the increase of contracts for permanent-discontinuous work or to a possible rising trend concerning the cases of employment contract termination during the probationary period. Finally, the text outlines pending issues and challenges for future reforms and overall conclusions.
