La Resolución 1373 (2001) del Consejo de Seguridad sentó los pilares de la estrategia global de las Naciones Unidas contra el terrorismo. Con el propósito de aplicar dicha resolución, el Consejo de la Unión Europea adoptó la Posición Común 2001/931/PESC, por medio de la cual se imponían medidas restrictivas (sanciones) a una serie de personas, grupos y entidades sospechosas de estar involucradas en la financiación o comisión de actos terroristas. Este trabajo comenzará examinando el papel de las sanciones internacionales como instrumento de lucha antiterrorista y valorando la incidencia de las decisiones del TJUE en los asuntos Kadi. A continuación se analizará el control jurisdiccional de las medidas restrictivas adoptadas en virtud de la Posición Común 2001/931 en la Unión Europea; concretamente se estudiará el alcance de las garantías procedimentales contenidas en los arts. 1.4 y 1.6 de la Posición Común, a la luz de la jurisprudencia reciente del TG y del TJUE en los asuntos LTTE (Liberation Tigers of Tamil Eelam) y Hamas. Dicho estudio permitirá comprender y valorar el contenido de los derechos de defensa y tutela judicial efectiva en la imposición de sanciones antiterroristas por parte del Consejo de la Unión Europea.
United Nations Security Council 1373 (2001) built the foundations for the UN Global Counter-Terrorism Strategy. In order to put that resolution into practice the Council of the European Union adopted the Common Position 2001/931/CFSP, in which restrictive measures (sanctions) concerning a number of people, groups and bodies economically or effectively involved in terrorist attacks were taken. The current piece of work will start by looking into the role of international sanctions as an antiterrorism weapon and will also assess the impact of EU Court of Justice decisions about the Kadi case. After that, which we will look into the legal juris¬dictional control of restrictions taken by the Common Position 2001/931/CFSP in the European Union, particularly the scope of procedure guaranties within the frame of 1.4 and 1.6 articles of Common Position viewpoint always under the umbrella of the EU Court of Justice and the General Court caselaw following the ltte(liberation tigers of tamil eelam) and Hamas cases. Such analysis will let us comprehend and assess the content behind the rights of defense and effective judicial protection concerning antiterrorism sanctions by EU Council
DieResolution 1373 (2001) des Sicherheitsrates legte den Grundstein für die globale Strategie der Vereinten Nationen zur Terrorismusbekämpfung. Zur Umsetzung dieser Resolution nahm der Rat der Europäischen Union den Gemeinsamen Standpunkt 2001/931/GASP an, mit dem restriktive Maßnahmen (Sanktionen) gegen eine Reihe von Personen, Vereinigungen und Körperschaften verhängt wurden, die im Verdacht stehen, an der Finanzierung oder Begehung terroristischer Handlungen beteiligt zu sein. In diesem Beitrag wird zunächst die Rolle internationaler Sanktionen als Instrument im Kampf gegen den Terrorismus untersucht und die Auswirkungen der Entscheidungen des EuGH in den Kadi-Fällen bewertet. Anschließend wird die gerichtliche Überprüfung von restriktiven Maßnahmen, die im Rahmen des Gemeinsamen Standpunkts 2001/931 in der Europäischen Union angenommen wurden, analysiert; insbesondere wird der Anwendungsbereich der in Artikel 1 Absatz 4 und Artikel 1 Absatz 6 des Gemeinsamen Standpunkts enthaltenen Verfahrensgarantien im Lichte der jüngsten Rechtsprechung des Gerichtshofs der Europäischen Union und des EuGH in den Fällen ltte(liberation tigers of tamil eelam) und Hamas untersucht. Diese Studie wird dazu beitragen, den Inhalt der Verteidigungsrechte und des effektiven Rechtsschutzes bei der Verhängung von AntiTerrorSanktionen durch den Rat der Europäischen Union zu verstehen und zu bewerten.
