El presente trabajo analiza cómo el TJUE, a partir de una novedosa interpretación del art. 19.1 TUE, ha afirmado su competencia para enjuiciar normativa nacional en materia judicial, sobre la base de que dicha normativa nacional no solamente regula órganos jurisdiccionales nacionales, sino, también, el Poder Judicial europeo. Asimismo, y al tiempo que ha afirmado su competencia de control, el TJUE ha comenzado a perfilar cuál debe ser el estatuto jurídico de los integrantes de ese Poder Judicial europeo, en el que se incluyen los jueces nacionales y en el que ocupa un lugar central el principio de independencia judicial.
This paper analyses how the CJEU has developed a new interpretation ofarticle 19.1 TEU, that allows him to assert his jurisdiction over national legislationon judicial matters. According to this ground-breaking case-law, judicial matters fall within the jurisdiction of the Court because they do not only refer to national judges, but also to European judges. In addition, the CJEU has gone one step further by starting to delineate and develop the legal status of the members of the European Judiciary, in which the principle of judicial independence plays a crucial role.
