El artículo 81.9 de la Ley General Tributaria ha atribuido a la Administración tributaria la potestad de asegurar cautelarmente las «responsabilidades pecuniarias» a las que hace referencia el artículo 126 del Código Penal, entre las cuales se encuentran las «multas». Este estudio se centra en analizar si la pena de multa (del tanto al séxtuplo), que eventualmente pudiera imponerse en una sentencia condenatoria por delito fiscal, puede considerarse incluida entre esas responsabilidades pecuniarias asegurables, para examinar, a continuación, si la atribución a la Administración tributaria de una potestad propia de la jurisdicción penal es compatible tanto con el principio de reserva jurisdiccional (art. 117.3 Constitución española –CE–) como con el derecho a la presunción de inocencia (art. 24.2 CE).
Under articles 81.9 of the Spanish General Taxation Law and 126 of the Spanish Criminal Code, the Tax Administration is entitled to adopt precautionary measures to ensure recovery of penalty payments (of up to six times the defrauded amount) that could be imposed in tax convictions.
The objective of this article is to determine whether investing the Tax Administration with a power that is exclusive to the judiciary is compatible with the principle of exclusive exercise of judicial power (article 117.3 of the Spanish Constitution) and the right to be presumed innocent (article 24.2 of the Spanish Constitution)
