Com o movimento de reabilitação da razão prática e a presença marcante de princípios e cláusulas gerais nos ordenamentos jurídicos de numerosos países, a partir da segunda metade do século XX, ganhou especial relevo o tema da discricionariedade judicial na interpretação dos casos jurídicos. Neste artigo, explicam-se os passos desse processo histórico de mudança e se sublinha a necessidade da formação ética do juiz como modo de se fazer bom uso da mencionada discricionariedade.
The subject of judicial discretionarity on the interpretation of legal cases has acquired special relevance from the second half of the 20th century thanks to the movement of rehabilitation of practical reason as well as to the inscription of the principIes and general clauses in the legal orders of several countries. In this article the author explains the paths of this historical process of change and highlights the need for a good ethical education of the judge so that he could make a fair use of the above mentioned dicretionarity.
