Este texto recoge la ponencia impartida en el marco de la mesa plenaria del congreso “sociedad reciclada, residuos y economía circular” en la que se analizó la incorporación de la Economía Circular en la legislación estatal de residuos a raíz de la Directiva (UE) 2018/851, en relación con los residuos municipales. El trabajo parte de la definición de Economía circular y de los objetivos que plantea a largo plazo y cuestiona el encaje en el sistema actual.
A continuación, se analiza el contenido de la Directiva (UE) 2018/851 que modifica la Directiva marco de residuos (DMR), ciñéndose a los residuos municipales, así como los distintos informes de la UE en relación con la evaluación del cumplimiento por parte de los EEMM de los objetivos inmediatos para 2020 en relación con la “sociedad del reciclado”. El trabajo se detiene en aquellas sugerencias y recomendaciones que la UE plantea, en especial a España, para lograr los objetivos fijados, y que la normativa debería incorporar.
Posteriormente, se estudia la normativa actual básica estatal en relación con los aspectos analizados desde un punto de vista crítico viendo cual es la situación actual y dando unas pinceladas a la situación de las CCAA. Finalmente, se plantean unas breves recomendaciones y conclusiones en relación con la futura LRSC, que debe incorporar la nueva DMR. Para ello se ha tenido en cuenta la situación de riesgo por parte del estado español de incumplir con los objetivos planteados, tanto para 2020 como para los años venideros a largo plazo.
This text contains the presentation given in the framework of the plenary table of the congress “Recycled society, waste and circular economy”, where was analyzed the incorporation of the circular economy in the state waste legislation following the Directive (EU) 2018/ 851 in relation to municipal waste. The work is based on the definition of circular economy and the long-term objectives and questions the fit in the current system. Next, it analyzes the content of Directive (EU) 2018/851 amending the Waste Framework Directive (WFD), with regard to municipal waste, as well as the different reports from the EU in relation to the evaluation of compliance by the SSMM of the immediate objectives for 2020 in relation to the "recycling society". The work is based on those suggestions and recommendations that the EU proposes, especially to Spain, to achieve the objectives set and which the regulations should incorporate. Subsequently, it studies the basic state current legislation in relation to the analyzed aspects from a critical point of view, seeing what the current situation is and giving a few touches to the situation of the Autonomous communities. Finally, we present brief recommendations and conclusions regarding the future Spanish waste law that have to incorporate the new WFD. This takes into account the risk situation of the Spanish state of not meeting the objectives set, both for 2020 and for the coming long term.
