En el presente estudio se analiza el tratamiento de la acción directa reconocida en los transportes terrestres en favor del porteador efectivo frente al cargador principal en el concurso del porteador contractual, que, en la cadena de transporte, ocupa la posición intermedia. Se trata de una acción muy distinta, en su funcionamiento y configuración, a la acción directa del arrendamiento de obra, establecida en favor del subcontratista contra el dueño de la misma, con lo que no puede considerarse sin más de aplicación lo indicado respecto de esta última acción en el Texto Refundido de la Ley Concursal para los supuestos de concurso del contratista-subcontratante. El concurso del porteador intermedio no va a afectar a la posibilidad de ejercitar la acción directa reconocida en este ámbito, pudiendo además continuar, en caso de haberse ejercitado con anterioridad. Ello, a su vez, conlleva la necesidad de analizar la insinuación, el reconocimiento y la clasificación de los créditos implicados.
This study analyses the treatment of direct action recognised in land transport in favour of the actual carrier as opposed to the main shipper in the event of bankruptcy of the contracting carrier, which in the transport chain occupies the intermediate position. This is a very different action, in its operation and configuration, to the direct action of the construction lease contract, recognised in favour of the subcontractor in relation to the owner of the same, so that what is indicated with regard to the latter action in the Spanish Insolvency Law for cases of bankruptcy of the contractor cannot be considered applicable. The bankruptcy of the intermediary carrier will not affect the possibility of exercising the direct action recognized in this area, and may also continue, if it has been exercised previously. This, in turn, entails the need to analyse the insinuation, recognition and classification of the claims involved.
