El presente artículo pretende exponer la inseguridad jurídica que ha generado el art. 473 de la Ley 14/2014, de 24 de julio, de Navegación Marítima, destinado al embargo preventivo de buques por deudas comunes. Este problema de carácter procesal se identifica con la ausencia de un criterio uniforme en cuanto a la atribución competencial de los tribunales españoles para conocer estas controversias que, si bien están reguladas en una norma específica, podrían no tener conexión alguna con el Derecho marítimo mercantil, más que por el propio bien que se pretende embargar.
This article attempts to expose the legal uncertainty set up by the article 473 of the Spanish law 14/2014, dated 24th July, on maritime navigation, which extend the international regulation by permitting the arrest of a ship in respect of other not maritime claims. This legal regulation causes procedural problmes regarding the absence of a uniform criteria considering the competence of the Spanish courts regarding those situations that, despite of being regulated in a commercial specific law, the could not have any connexion with business maritime issue, just for the presence of a vessel in the process.
