In this article, emphasis is placed on the analysis of the worldwide movement of access to justice, which emerged after World War II, and aimed at making the legal system accessible to all regardless of income. In response to the gap problem of access to justice, the movement in question comprises five renewal solutions and/or "waves", embodied in legal aid for the poor; in legal representation for diffuse interests; broadening the focus on access to justice; on the ethical and political dimension of law; as well as in the internationalization of the protection of human rights. The study covers from the conceptual transformations of access to justice to the projects of reforms of the juridical systems and, to this end, draws on the theoretical and empirical contributions made by Mauro Cappelletti & Bryant Garth, Kim Economides and Diogo Esteves & Franklyn Roger Alves da Silva. With the advent of such a movement, in different countries, and in different ways, there is a concern to make access to justice a right for all, not a privilege for a few, and in this sense, beckons for the affirmation of citizenship and the empowerment of individuals.
Neste artigo, a ênfase recai na análise do movimento mundial de acesso à justiça, surgido após a Segunda Guerra Mundial, e destinado a tornar o sistema jurídico acessível para todos, independentemente da renda. Em resposta ao gap problem do acesso à justiça, o movimento em comento conforma cinco soluções e/ou “ondas” renovatórias, consubstanciadas na assistência jurídica para os pobres; na representação jurídica para os interesses difusos; no alargamento do enfoque de acesso à justiça; na dimensão ética e política do Direito; bem como na internacionalização da proteção dos direitos humanos. O estudo abrange desde as transformações conceituais do acesso à justiça até os projetos de reformas dos sistemas jurídicos e, para tanto, vale-se das contribuições teóricas e empíricas desenvolvidas, sobretudo, por Mauro Cappelletti & Bryant Garth, Kim Economides, e Diogo Esteves & Franklyn Roger Alves da Silva. Com o advento de tal movimento, em distintos países, e de diferentes formas, percebe-se uma preocupação em tornar o acesso à justiça um direito de todos, e não um privilégio para poucos e, nesse sentido, acena para a afirmação da cidadania e o empoderamento dos indivíduos.
