The sexual contract is a concept that shows, in a political and historical perspective, how the constitution of society was based on the denial of the human condition to the woman. The purpose of this essay is to create guidelines about the content of this theory, in a didactic and non-exhaustive way, linking it to the Brazilian reality. Our argument is that, from the theory raised by Carole Pateman, it is possible to affirm that, according to the patriarchal structure of society, women can be relegated to a status not as subject, but as property, whose scope of freedom does not reach the spheres where real civil liberties are exercised. The text brings to light issues of power that are based on the invisible structures of patriarchy and also points out how Brazilian law has built and reformulated its legal provisions in this environment of inferiority and denial of voice to women.
O contrato sexual é um conceito que mostra, em uma perspectiva política e histórica, como a constituição da sociedade se fundamentou na negação da condição humana à mulher. O objetivo deste ensaio é criar delineamentos sobre o conteúdo dessa teoria, de maneira didática e não-exaustiva, vinculando-a à realidade brasileira. Nosso argumento é que, a partir da teoria suscitada pela Carole Pateman, é possível afirmar que, em função da estrutura patriarcal da sociedade, à mulher pode ser relegado o status não de sujeito, mas de propriedade, cujo âmbito de liberdade não alcança as esferas públicas, onde as verdadeiras liberdades civis são exercidas. O texto traz à tona questões de poder que se fundamentam nas estruturas invisíveis do patriarcado e também aponta como o direito brasileiro construiu e reformulou suas disposições legais neste ambiente de inferiorização e de negação de voz às mulheres.
