This article outlines a comparative study between Portugal and Brazil regarding the role of the service provider state and judicial control. Thus, the proposal is to identify congruent points of both countries capable of generating reflection on the exposed theme. In order to do so, it uses the organization in three chapters, the first presents the structure of the judiciary in Portugal with the legal reform with the “Law of Good Reason” and its reflexes. The second chapter deals with the judicial function and the Portuguese constitution. It begins by asking about the competence of the Portuguese judges regarding the application of the norm and its adherence to the text or expansiveness of interpretation and free convincing. The third chapter focuses on the Brazilian reality, the crisis of jurisdiction, the limits of the judiciary as one of the essential functions of the State and excessive judicialization in a citizen culture under construction.
The conclusion is based on the analysis of the classical conceptualization of separation of powers, as well as the intervention of the Judiciary in the other powers, which discharges the separation and configures the activism and judicial protagonism in the social relations, even if of adverse competence to its own. For the development of this article, the bibliographical methodology is used, aiming to contribute to the evolution of the state service provider and judicial control, inspired by the European model, based on the Portuguese reality.
O presente artigo traça um estudo comparativo entre Portugal e Brasil no tocante ao papel do Estado prestador de serviços e o controle judicial. Assim, a proposta é identificar pontos congruentes de ambos os países capazes de gerar reflexão a respeito da temática exposta. Para tanto, vale-se da organização em três capítulos, o primeiro apresenta a estrutura do poder judiciário em Portugal com a reforma jurídica com a “Lei de Boa Razão” e seus reflexos. O capítulo segundo versa sobre a função judicial e a constituição portuguesa. Inicia-se indagando quanto a competência dos juízes Portugueses no tocante a aplicação da norma e sua aderência ao texto ou expansividade de interpretação e livre convencimento. O terceiro capítulo se dedica à realidade brasileira, a crise da jurisdição, os limites da atuação do judiciário como uma das funções essenciais do Estado e a judicialização excessiva em uma cultura cidadã em construção. A conclusão perpassa pela análise da clássica conceituação de separação dos poderes, bem como pela intervenção do Poder Judiciário nos demais poderes, o que descaracteriza a separação e configura o ativismo e protagonismo judicial nas relações sociais mesmo que de competência adversa à sua. Para o desenvolvimento deste artigo, emprega-se a metodologia bibliográfica, visando contribuir para a evolução do Estado prestador de serviços e do controle judicial, com inspiração no modelo europeu, a partir da realidade portuguesa.
