Este trabalho apresenta a globalização como um fenômeno orquestrado no centro para naturalizar a nova ordem econômica mundial baseada neoliberalismo, que demandava o enfraquecimento do Estado nacional, especialmente dos países periféricos, e a sujeição da constituição nacional em prol dos interesses do capital privado, principalmente o estrangeiro. O trabalho foi organizado da seguinte maneira: (i) revistar a literatura sobre as taxonomias de globalização; (ii) apropriar-se da teoria econômica para fundamentar a gênese da propagação da globalização; e (iii) mostrar que na América Latina a ascensão das ideias neoliberais, importadas do centro do capitalismo, provocou uma"onda" de reformas constitucionais receptivas principalmente ao capital estrangeiro.
This essay presents globalization as a phenomenon organized in the center of the world to naturalize the new world economical order based on the neoliberalism, which demanded the weakening of the National State, specially those from the peripheral countries, as well as the subjection of the national constitution in favor of the interests of the private capital, mainly the foreign one. This issue was organized the following way: (i) reviewing the literature about the taxonomies of globalization; (ii) appropriating the economical theory to establish the genesis of the spread of globalization; and (iii) showing that in Latin America, the rise of neoliberal ideas, imported from the center of capitalism, caused a “wave” of receptive constitutional reforms, principally to the foreign capital.
