O presente trabalho visa analisar se o princípio da presunção da inocência, previsto expressamente no texto constitucional é ferido pela aplicação das Leis Complementares 64/1990 e 135/2010, ao prever a inelegibilidade para pessoas condenadas em decisão proferida por órgão judicial colegiado antes do trânsito em julgado até o transcurso do prazo de 8 (oito) anos após o cumprimento da pena. As decisões do Supremo Tribunal Federal por meio de Controle de Constitucionalidade abordam e evidenciam a problemática de sobreposição do interesse público em relação à presunção de inocência do acusado, dando prevalência interesse público.Palavras-chave: Inelegibilidade; Presunção da inocência; Proteção.
The present work aims to analyze if the principle of presumption of innocence, expressly provided in the Constitution is offended by the application of Complementaries Law 64/1990 and 135/2010, when predicting the ineligibility for people convicted through a collegiate court decision before the res judicata to the elapsed period of eight (8) years after serving his/her sentence. The decisions of the Supreme Court through Judical Review address and highlight the problematics of public interest override with respect to the presumption of innocence of the accused, giving priority to the public interest.Keywords: Inegibility; Presumption of innocence; Protection.
