El derecho procesal constitucional tiene tres antecedentes históricos principales, que son el Habeas Corpus Act inglés en 1679, el control de constitucionalidad en 1803 en el caso Merbury vs. Madison por la Corte Suprema norteamericana y la creación por la Constitución Austríaca del Tribunal Constitucional en 1920. Después de relatar la historia del nacimiento del derecho procesal constitucional, el texto expone las tesis sobre su naturaleza jurídica, que puede ser el derecho constitucional, el derecho procesal o los dos. También versa sobre la cuestión cuanto al objeto del derecho procesal constitucional y las tesis sobre eso. El texto aborda también el desarrollo del derecho procesal constitucional cuanto a la enseñanza, la legislación y la doctrina en América Latina, haciendo al fin algunas consideraciones sobre él en Europa.Palabras clave: derecho procesal constitucional, América Latina, proceso, constitución.
Constitutional procedural law has three main historical antecedents, which are the English Habeas Corpus Act in 1679, the control of constitutionality in 1803 in the case Merbury vs. Madison by the U.S. Supreme Court and the establishment of the Constitutional Court by the Austrian Constitution in 1920. After describing the history of the birth of constitutional procedural law, the text describes the theses on its legal nature, which may be constitutional law, procedural law, or both. It also discusses the object of constitutional procedural law and the theses about it, as well as its development regarding education, legislation and doctrine in Latin America, finally making some considerations about constitutional procedural law in Europe.
