El objeto de este trabajo es poner en cuestión el modo en que se ha desarrollado la protección del agua en un momento en que la situación hídrica en España y, en el mundo en general, es alarmante. Se analizarán los principales dilemas que la tutela penal ha planteado, así como su protección constitucional. Por último, se defenderá el recurso a las medidas preventivas y la necesidad de una eficaz actuación a nivel internacional como la única vía coherente con el respeto al principio de intervención mínima del derecho penal. Las herramientas para salvaguardar este recurso escaso habrán de ser buscadas en otros lugares.
It is the aim of this paper to question the way in which water protection has been developed at a time when the water situation in Spain and, in the world in general, is alarming. The main dilemmas that criminal protection has raised will be analyzed, as well as its constitutional protection. Finally, the use of preventive measures and the need for effective action at the international level will be defended as the only way consistent with respect for the principle of minimum intervention of criminal law. The tools to safeguard this scarce resource will have to be sought elsewhere.
