This is the legal analysis of the case Luiza Melinho vs. Brazil, in which a transsexual woman had her sexual reassignment surgery repeatedly denied by national administrative and judicial bodies. The research problem that is answered is what will be the appropriate approach for the case, considering the norms of international human rights law and Brazilian constitutional law. The general objective is to explore how the Inter-American Court of Human Rights can decide Luiza Melinho's demand, which is pending a response. As specific objectives, the functioning of the Inter-American Human Rights System is investigated, explaining previous cases relating to LGBTQIAP+ people, in addition to cases submitted to the jurisdiction of the Brazilian Constitutional Court. The method used is hypothetical-deductive, based on the hypothesis that Brazil will be held internationally responsible for the delay in providing surgical procedures, in addition to having to compensate the victim for the situations suffered.
Trata-se da análise jurídica do caso Luiza Melinho vs. Brasil, em que uma mulher transexual teve sua cirurgia de redesignação sexual negada, reiteradamente, pelas instâncias administrativas e judiciais nacionais. O problema de pesquisa que se responde é acerca de qual será o encaminhamento adequado para o caso, considerando-se as normas do direito internacional dos direitos humanos e do direito constitucional brasileiro. O objetivo geral é explorar como a Corte Interamericana de Direitos Humanos pode decidir a demanda da Luiza Melinho, que está pendente de resposta. Como objetivos específicos averígua-se o funcionamento do Sistema Interamericano de Direitos Humanos, sendo explicitados casos anteriores relativos a pessoas LGBTQIAP+, além de casos submetidos à jurisdição da Corte Constitucional brasileira. O método utilizado é o hipotético-dedutivo, partindo-se da hipótese de que o Brasil deverá ser responsabilizado internacionalmente pela mora em fornecer os procedimentos cirúrgicos, além de ter que indenizar a vítima pelas situações sofridas.
