This paper aims to address the problem related to military proceedings in which the rights to religious freedom is invoked as grounds for refusing to comply with a hierarchical order, thus compromising military hierarchy and discipline. It recalls the historical progress in the conquest of fundamental rights and how Brazilian constitutions have, over the years, guaranteed the right to religious freedom. It highlights the importance of preserving military hierarchy and discipline, values also guaranteed by the Federal Constitution. It then analyzes the possibility of these two precepts coexisting, based on an analysis of a fictitious case in which Habermas theory of communicative action is used as a theoretical reference.
Este trabalho pretende abordar um problema relacionado com o processo militar em que a liberdade religiosa é diretamente invocada como base para desafiar ou cumprir uma ordem hierárquica, comprometendo assim a hierarquia e a disciplina militar. Relembrar o avanço histórico na conquista de dois direitos fundamentais e como as constituições brasileiras garantem, ao longo de dois anos, ou diretamente à liberdade religiosa. Ressalta-se a importância da preservação da hierarquia e da disciplina militar, valores também assegurados pela Constituição Federal. A seguir, analisa as possibilidades de coexistência desses dois preceitos, a partir da análise de um caso fictício em que utiliza a teoria da razão comunicativa de Habermas, como referencial teórico.
