El presente artículo procura exponer diversas reflexiones, desde una dimensión filosófica moral, jurídica y política, sobre la vinculación que pueda existir entre nociones tales como el bien común, la dignidad humana y la democracia liberal. Para ello se ha optado por emplear un específico pensamiento iusfilosófico, el cual es el denominado postpositivismo jurídico, pretendiendo desarrollar las ideas que algunos de sus más importantes exponentes en la actualidad han plasmado en torno a tres de los principales elementos de tal iusfilosofía, tales como: el constitucionalismo, el objetivismo moral y el entendimiento del Derecho como práctica social, los cuales a su vez tienen estrecha relación con las nociones antes mencionadas. Sin perjuicio también se emplean autores provenientes de otras tradiciones intelectuales para enriquecer el diálogo con la iusfilosofía postpositivista.
This article seeks to present various reflections, from a philosophical, moral, legal and political dimension, on the relationship that may exist between notions such as the common good, human dignity and liberal democracy. For this purpose, a specific iusphilosophical thinking has been chosen, which is the so-called postpositivism, The aim is to develop ideas which some of its most important exponents have today shaped around three of the main elements of such a philosophy, such as: constitutionalism, moral objectivism and the understanding of law as a social practice which in turn are closely related to the notions mentioned above. Without prejudice, authors from other intellectual traditions are also employed to enrich the dialogue with the post-positivist philosophy.
