Este artículo explora el actual nivel de implementación del derecho a la defensa especializada en Chile. Primero, se caracteriza el origen y desarrollo de este derecho. Luego, sistematiza los principales estándares aplicables a este derecho cuando sus titulares son niños, niñas y adolescentes. Enseguida, evalúa el nivel de incorporación normativa de los estándares previamente identificados en los procedimientos penales, proteccionales y de familia concernientes a niños, niñas y adolescentes en Chile, para analizar el funcionamiento de las políticas públicas que se han creado para implementar este derecho. Para concluir, se realiza una valoración general de los hallazgos realizados.
This article explores the current level of implementation of the right to children specialized legal defense in Chile. The first part seeks to characterize the origins and deve lopment of the right of specialized legal defense. Later, it focuses on systematizing the main human rights standards applicable to that right in regard to children group. The second part evaluates the level of normative incorporation of the standards previously identified in child involved procedures. To analyze the performance of public policy measures implementing the right to children specialized legal defense. To conclude, this article assesses the implementation process of this specific right in light of the evidence gathered throughout this article.
