El "Acquis Communautaire" es el instrumento perfecto para explicar el proceso de formación de la normativa digital europea. Esta investigación se centra en la delineación de su definición, origen, contenido y formación con el objetivo de encontrar similitudes en el desarrollo del cuerpo normativo digital de la Unión Europea y afirmar que un "Acquis Communautaire" Digital está siendo creado. Además, la investigación busca analizar las implicaciones que dicha creación tiene, en concreto, la conveniencia de armonizar la regulación digital teniendo como vértice el Reglamento General de Protección de Datos (GDPR) y la estrategia de Inteligencia Artificial (IA) como modelo de codificación, con la Comisión como órgano central de control. Entre los modelos de expansión del Acervo, se exploran el Efecto Bruselas, elementos de política exterior, el régimen de transferencia de datos y los instrumentos bilaterales de los Tratados, donde se concluye que aquellos obstáculos normativos y políticos, tanto internos como externos, a los que se ha enfrentado la Unión Europea pueden ser resueltos con el uso del "Acquis Communautaire" como herramienta que otorga coherencia normativa y avanza en la consecución de la soberanía digital europea.
The "Acquis Communautaire" is the perfect instrument to explain the process of formation of European digital regulation. This research focuses on the delineation of its definition, origin, content, and formation with the aim of finding similarities in the development of the European Union’s digital regulatory body and asserting that a Digital "Acquis Communautaire" is being created. Furthermore, the research seeks to analyse the implications that such a creation has, in particular, the desirability of harmonising digital regulation with the General Data Protection Regulation (GDPR) and the Artificial Intelligence (AI) strategy as a codification model, with the Commission as the central controlling body. Among the models of expansion of the Acquis, the Brussels Effect, foreign policy elements, the data transfer regime and the bilateral instruments of the Treaties are explored, where it is concluded that those regulatory and political obstacles, both internal and external, that the European Union has faced can be resolved with the use of the "Acquis Communautaire" as a tool that provides regulatory coherence and advances in the achievement of European digital sovereignty.
