Es preocupante no tener certezas acerca de si uno dispone o no de razones que puedan aportar soluciones prácticas y a la vez, saber con certeza que el MERCOSUR, así no puede funcionar. Se construyó sobre estructuras jurídicas débiles y se intentó actuar cómo si fueran fuertes. Cuando se quiere ayudar para modificar la situación, se siente que se clama en el desierto. El artículo trasmite experiencias personales, algo de historia y especialmente la opinión del autor acerca de que los constructores del MERCOSUR no han tenido en cuenta y siguen sin tenerla, lo importante de las estructuras jurídicas y del espíritu judicial para solucionar controversias y encausar estos procesos. Y qué sin considerarlo, no se evitarán, ni superarán, las crisis como la que se vislumbra.
It is worrying not to be certain about whether or not one has reasons that can provide practical solutions and, at the same time, to know with certainty that MERCOSUR cannot work like that. It was built on weak legal structures and an attempt was made to act as if they were strong. When you want to help change the situation, you feel like you are crying out in the desert. The article transmits personal experiences, some history and especially the author's opinion that the MERCOSUR builders have not taken into account and still do not take into account the importance of legal structures and the judicial spirit to solve controversies and prosecute these processes. And without considering it, crises like the one looming will not be avoided or overcome.
