After the Brazilian Constitution of 1988 there was a significant increase in activity of the Judiciary Branch in Brazil. This paper aims to present factors that led the judiciary to occupy broader roles related to public policies creation. The comprehension of the factors indicates that the Executive and the Judiciary had its powers increased in the period, while the Legislature seems to have taken a less prominent role, setting up an institutional reorganization not foreseen in the Brazilian Constitution. We analyze each of the three powers in a different section, searching for relevant factors that help to understand the phenomenon and the interaction of powers in Brazil.
Após a Constituição de 1988, houve um significativo aumento da atuação do Poder Judiciário no Brasil. Esse estudo pretende apresentar fatores que levaram o judiciário a ocupar papeis mais amplos na criação de políticas públicas. A compreensão dos fatores indica que o Poder Executivo e o Poder Judiciário tiveram suas competências aumentadas no período, enquanto o Poder Legislativo parece ter assumido um papel de menor proeminência, configurando uma reorganização institucional não prevista na Constituição. Analisamos cada um dos três poderes em uma seção separada, buscando por fatores relevantes para ajudar a compreender o fenômeno e a interação de poderes no Brasil.
