The aim of this paper is to highlight the Fund of the Diffuse Rights - FDD as an economic instrument for the achievement of rights and constitutional guarantees. In order to reach the objective initially, it was tried to establish a line of relation between the law and the economy in the context of the Economic Order, paying attention to the abuse of economic power and the infractions against it. It presented aspects of transindividual rights, new paradigms and doctrinal discussions about their concepts and entitlements. For that, the theory of Edilson Vitorelli and the study and analysis of the data of the Fund of Diffuse Rights of 2016 were referenced. As a theoretical framework, we opted for bibliographical research with data analysis of the FDD and the legislation, using the method of hypothetic-deductive research.
O presente trabalho tem como objetivo elucidar a importância do Fundo dos Direitos Difusos -FDD como instrumento econômico para o alcance de direitos e garantias constitucionais. Para atingir o objetivo inicialmente procurou-se estabelecer uma linha de relação entre o direito e a economia no contexto da Ordem Econômica, atentando para a questão do abuso do poder econômico e da infrações contra ela praticadas. Apresentou-se aspectos dos direitos transindividuais, os novos paradigmas e discussões doutrinárias sobre seus conceitos e titularidades. Para tanto, a teoria de Edilson Vitorelli e o estudo e análise dos dados de 2016 do Fundo dos Direitos Difusos foram referenciados. Como arcabouço teórico, optou-se por uma pesquisa bibliográfica com análise dos dados do FDD e da legislação, utilizando o método de pesquisa hipotpetico-dedutivo
