O presente artigo se assenta na necessidade da criação de um sistema multinível de proteção para que os direitos fundamentais sejam efetivados. Adota-se a metodologia analítica documental e bibliográfica para tanto, utilizando-se como recorte histórico a distinção entre Direitos Fundamentais e Direitos Humanos, bem como demais transformações ocorridas no movimento denominado de constitucionalismo, desaguando nas modernas teorias do neoconstitucionalismo. Tem-se que a problemática da questão reside na base dos direitos fundamentais, qual seja, a dignidade da pessoa humana, fundamento que orienta uma pluralidade de elementos essenciais e suporte maior para a concepção de tais direitos e, ainda, princípio no qual se pautam os principais sistemas constitucionais modernos. Os objetivos da presente pesquisa são destacar que o Estado deve fomentar e respeitar a existência digna do ser humano, valorizando-o tanto em sua dimensão individual quanto em um contexto de justiça, através de um diálogo que fomente a criação de mais uma ferramenta de proteção dos Direitos Humanos e que seja capaz de sobrepujar a soberania estatal e criar uma jurisprudência quanto a punições a violações de tais direitos.Palavras-chave: Direitos Fundamentais, Direitos Humanos, Sistema Multinível.
This article is based on the need to create a multilevel system of protection for fundamental rights to be effective. The documentary and bibliographic analytical methodology is adopted for this purpose, using as a historical cut the distinction between Fundamental Rights and Human Rights as well as other transformations occurred in the movement called constitutionalism, passing to the modern theories of neo-constitutionalism. The problem lies in the basis of fundamental rights, that is, the dignity of the human person, a foundation that guides a plurality of essential elements and a greater support for the conception of these rights, and also a principle on which the main modern constitutional systems are based. The objectives of the present research are to emphasize that the State must foster and respect the dignified existence of the human being, valuing it both in its individual dimension and in a justice context — through a dialogue that fosters the creation of another tool for the protection of Human rights and that enables to overcome the state sovereignty —, and creating jurisprudence regarding punishment for the violations of such rights.Keywords: Fundamental Rights, Human Rights, Multilevel System.
