Researchers are in agreement in highlighting the disruptive effects that the introduction of Artificial Intelligence (AI) may have on the insurance contracting, with some even questioning whether, as a result, the traditional frameworks on which the insurance contract law is based have become obsolete and need to be replaced by new ones. The aim of this paper is to ascertain whether this possibility is feasible or whether it is merely a theoretical notion arising from the initial enthusiasm that typically characterises the reception of any technological innovation. To this end, the paper analyses the deep evolution that, over a relatively short period of time, has taken place in the way the application of AI in insurance contracting is conceived, in order to ultimately seek an answer to the question of whether we are facing an example of «Gattopardism», in reference to Lampedusa’s famous novel and the phrase uttered by the character Tancredi, according to which we need «everything to change, so that everything remains the same», elucidating whether this entire technological revolution is merely a mechanism to ensure that, in essence, the foundations of insurance contract law remain unchanged.
