Late payment surcharges, as set forth in articles 28 and 30 of the General Social Security Act (LGSS), are not penalties, as they lack a punitive or retributive purpose regarding administratively unlawful conduct. They accrue automatically upon the mere expiration of the statutory deadline for payment of social security contributions. Current regulations only exclude their application when the failure to pay on time is attributable to an error by the Administration, provided the latter is not acting in its capacity as an employer. The principle of legitimate expectations cannot exempt from the surcharge.
