Currently, over 230 million girls and women today have been victims of female genital mutilation practice in thirty countries across Africa, the Middle East, and Asia—a reality that extends to host countries of migrant communities, including Portugal. Despite its autonomous criminalisation in Portugal since 2015 and the increasing number of reported cases, there is a notable absence of convictions for this practice. Female genital mutilation is a culturally motivated practice that not only reflects a structural gender inequality but also represents an extreme form of violence and discrimination against women and girls. On the one hand, the revolution marked the beginning of the end of a patriarchal structure in Portugal; on the other, it paved the way for transcultural dialogue by bringing together people of diverse backgrounds, social classes, and nationalities. Since then, both society and the State have evolved significantly in recognising and valuing cultural diversity. This article examines the main obstacles to the criminal liability for female genital mutilation, focusing on the challenges of evidence production and on the influence of cultural contexts. It also discusses, from the perspective of criminal law doctrine, the influence of cultural motivation on the formation of the agent’s will, exploring the limits of a “cultural exception” compatible with human rights. While origin, culture, or religion can never legitimise violations of basic rights, we must remain sensitive to each individual’s cultural references. The intersection of these two forms of discrimination demands that we be able to embrace diversity without either yielding in the defence of basic rights or compromising the core principles of the rule of law. As long as forms of discrimination persist — whether based on gender or culture — the democracy promised by the April revolution will remain unfulfilled.
