The Court of Justice of the European Union has again ruled in Case C-511/17 (Lintner) on the duty of the national courts to examine ex officio the unfairness of particular terms in consumer contracts, as it has been holding for some years as a result of the interpretation of Directive 93/13/EEC. The Court considers that, in proceedings brought by a consumer seeking a declaration that certain contractual terms are unfair, the national courts have a duty to review only the terms relating to the subject-matter of the dispute and not all the terms of the contract. This text provides a critical analysis of the decision.
