The article critically examines the use of AI-driven recommendation systems in online job portals and their impact on digital labour intermediation, highlighting the risks of algorithmic discrimination and black-box algorithms. It analyses their regulatory framework under Law 3/2023 on Employment, the Workers’ Statute, Law 15/2022, the GDPR and AI Regulation (EU) 2024/1689, identifying gaps stemming from their exclusion from the legal regime governing employment agencies and from regulatory asymmetries between the public and private sectors. It systematises documented biases based on gender, age, origin or disability as forms of indirect discrimination and proposes integrating digital platforms into the employment agency regime, strengthening transparency and auditing duties, adjusting evidentiary rules, and clarifying corporate responsibilities.
