Objective grounds for cassation are included as a new and key requirement for appeals in cassation for the unification of case law brought before the Social Chamber of the Supreme Court, as a consequence of the reform carried out by Organic Law 1/2025 of January 2nd, on measures regarding the efficiency of the Public Justice Service, in articles 219.1 and 3, 221.1 and 2 c), 223.2, 224.1 c) and 5, 225.1, 3, 4 and 5 of Law 36/2011, of October 10th, regulating the social jurisdiction. In addition, the Agreement of the General Council of the Judiciary (CGPJ) of April 8th 2025, on the maximum length and extrinsic conditions of the briefs for formalizing or filing and challenging appeals in cassation addressed to the Fourth Chamber of the Supreme Court, incorporates extrinsic or formal obligations for the presentation of briefs. The judgment of the Plenary of the Social Chamber of the Supreme Court 495/2026, of May 22nd (Rec. 3239/2025) is the first to address not only in what cases the existence of objective grounds for cassation will be appreciated, but also what other intrinsic or substantive requirements, or extrinsic or formal requirements, must be met for the admission of appeals for the unification of doctrine. While it clarifies some issues, it leaves others open that are identified in this study and for which solutions are offered, such as: what period should be granted to remedy formal defects, who will be competent to grant it, in what cases there will be special and singular circumstances to overcome the length of the appeal document, how the existence of objective cassation interest should be justified in accordance with sections a), b) and c) of article 219.1 of Law 36/2011, of October 10, regulating the social jurisdiction, and what consequences will the non-compliance or erroneous compliance with the obligation to justify the objective cassation interest have.
