Although the agreement of ILO Convention 190 of 2021 and the recent jurisprudence of the Constitutional Court allow for recognizing workplace harassment without the need for repetition in the behavior or even for it to cause an actual harm to the moral patrimony of the aggrieved person, it is still necessary, in order to appreciate the constitutive elements of it, that the circumstances in which the persecution occurs are objectively proven and that these behaviors (verbal, physical, etc.) are of objectively relevant intensity to deduce from them a harmful purpose.
