The expansion of remote work has revealed the limitations of Law 10/2021 and has required significant interpretative efforts by the courts in order to provide coherence to the legal framework governing telework. Case law has clarified indeterminate concepts, defined the scope of employers’ obligations, and corrected contractual clauses intended to circumvent rules of mandatory employment law. It has also determined the reach of the minimum content required in remote work agreements and its interaction with the broader principle of legal certainty. This hermeneutic process has prevented the improper transfer of risks to workers, strengthened guarantees such as privacy, digital disconnection, and occupational health and safety, and consolidated a doctrinal body that brings stability and legal certainty to an institution still undergoing normative development.
