This paper addresses the reform introduced into the Civil Code by Law 8/2021 regarding relative incapacities (prohibitions) for inheritance (Art. 753.2 CC). It questions the scope of the reform, which limits the capacity to freely dispose of one’s estate upon death, for individuals residing in a care facility, in favor of the staff who care for them or the facility itself. The position defended is based on the need to interpret the expression “persons interned for health or care reasons”, paying particular attention to the spirit and purpose of the law (Art. 3.1 CC), the need to alter the scope of the presumption of undue influence on the testator’s will (from absolute to relative), and, finally, the compatibility between the testator’s situation and the existence, where applicable, of support measures (caregiving guardianship), which would favor considering the testamentary disposition entirely free.
