Based on an analysis of how the Spanish police investigate and prosecute crimes, this study seeks to determine the degree of autonomy they exercise in relation to the judiciary. To this end, in addition to examining the current legal framework, interviews were conducted with 19 members of the various Spanish law enforcement agencies. The selection considered gender representation and included individuals at different hierarchical levels, all with responsibilities in criminal investigations. The article reveals that the police operate from a position of technical specialization, exercising a high degree of autonomy from judges and prosecutors, with a focus on securing the conviction of the suspect. Based on these findings, the study questions whether the current system may compromise fairness and the final result of the criminal process
