This article proposes a critical rereading of the concept of terrorism from the perspective of legal theory and political philosophy, arguing that this category does not designate an autonomous and empirically delimitable class of violence, but rather operates as an empty and performative signifier through which sovereign power reconstitutes itself, declares the exception, and draws the boun-dary between those who are entitled to legal protection and those who may be reduced to bare life. Building on a critical genealogy of violence in law —drawing on Hannah Arendt, Walter Benjamin, Carl Schmitt, and Simone Weil—, the article integrates this framework with Slavoj Žižek’s theory of the radical political act, in order to propose a tripartite test that distinguishes when a violent act opens an emancipatory horizon and when, by contrast, it becomes reactionary, spectacular, or nihilistic violence functional to the sovereign order. The argument is further developed through a specific analysis of state terrorism, drawing on Jacques Derrida’s reading of the concept «philosophy in a time of terror» demonstrating that this formulation is not an oxymoron but rather the repressed truth of the concept—that is, structural evidence that the juridical monopoly of violence implicates the State, in its acts of mass repression against civilian populations, in the very logic it purports to combat. The article thus seeks to shift the traditional doctrinal question of defining terrorism toward the more fundamental issue of the threshold between forms of violence that inaugurate the political and those that foreclose it.
