La libertad de creación, reconocida en el artículo 20.1 b) de la Constitución española como un derecho fundamental autónomo que se ejerce a través de la literatura y el arte, no se agota en la protección individual del creador, sino que cumple una función estructural en el aseguramiento de la cultura. Partiendo de dicha premisa, el trabajo analiza la reciente jurisprudencia constitucional, en particular las sentencias dictadas en 2025, con el fin de precisar el alcance de la libertad de expresión literaria y artística a partir del juego entre realidad y ficción que caracteriza a la creación cultural.

Freedom of creation, recognised in Article 20.1(b) of the Spanish Constitution as an autonomous fundamental right exercised through literature and art, is not confined to the individual protection of the creator, but also performs a structural function in safeguarding culture. Building on this premise, the article examines recent constitutional case law, particularly the judgments delivered in 2025, in order to delineate the scope of literary and artistic freedom of expression through the interplay between reality and fiction that characterises cultural creation.
