This article adopts a qualitative methodological approach focused on a documentary review of the sociolegal dimensions of access to public merit for ethnic educators and the tensions that have arisen around understandings of identity, self-recognition, and cultural traditions. The selection and study of rulings highlights the need to understand the interaction between law and society through jurisprudential maxims that define and complement the spirit of current constitutionalism through the development of fundamental rights (individual or collective). The outcome of each case studied allows for the systematization of the binding position of law through the arguments, discussions, and decisions offered by the highest constitutional jurisdiction regarding the autonomy of ethnic governments to select their teaching staff; the definition of the curriculum in cultural contexts; the delimitation of the scope of the denomination of ethnic minorities; and the safeguarding of due process in the granting of endorsements by indigenous authorities to their ethnic educators.
