The article analyzes the legacy of federalist thinking in the US Constitution of 1787. After independence, the debate between Federalists and Anti-Federalists focused on how to structure the new state to avoid anarchy and the tyranny of the majority, as evidenced in conflicts such as Shays' Rebellion. Promoted by James Madison, the main federalist contribution was the system of “checks and balances”. This mechanism sought to control factions through the partial division of powers, providing each branch of government (executive, legislative, and judicial) with tools to restrain the others, such as the presidential veto, bicameralism, and judicial review of constitutionality. Although the federalist model ensured political stability and was widely imitated, it was not without its critics. Anti-Federalists denounced its aristocratic character, the distance between representatives and citizens, and the risk of mutual blockage between powers. The final balance, therefore, recognizes both the achievements in containing oppression and the democratic deficits that the institutional design continues to carry to this day.
