El Tribunal Supremo casa la sentencia de la Sala de lo Social del TSJ de Madrid que consideró improcedente el despido al computar las faltas de asistencia probadas de mes a mes natural y no de fecha a fecha. Declara firme la procedencia del despido disciplinario al verificarse la concurrencia de las faltas injustificadas prevista en el convenio colectivo dentro del periodo continuado de un mes desde la primera ausencia utilizada para el cómputo.
The Supreme Court overturns the judgment of the Social Chamber of the High Court of Justice of Madrid, which had declared the dismissal unfair on the basis of calculating the proven absences by calendar month rather than on a date to date basis. The Supreme Court upholds the lawfulness of the disciplinary dismissal, finding that the number of unjustified absences required under the applicable collective agreement occurred within a continuous one month period counted from the first absence used as the starting point for the calculation.
